TERMS AND CONDITIONS OF ENTRY INTO PROMOTION FOR BRAVENEWCODE INC. (Promoter) 

By entering the Promotion, all Entrants are deemed to have read, understood, accepted and agreed to the following Promotion Terms and Conditions:

Entrants

01. Employees of the Promoter, their immediate family and anyone else connected to the creation or administration of the Promotion are not eligible to enter.
02. Failure to comply with any of these terms and conditions will disqualify any Entrant from taking part in the Promotion and the entry will be invalid. The Promoter retains sole discretion to refuse Entrants the right to enter if it feels that these terms and conditions are not being complied with or for any valid and justifiable reason.
03. The Promoter reserves the right to disqualify any Entrant and/or winner and/or amend these Terms and Conditions at any time for any reason in its absolute discretion.
04. For Prize A, entrants and winners must reside in North America or EU countries.

Entries

04. The Promotion will OPEN at 08:00AM EST on 13th December 2010, and END at 12:00PM EST 17th December 2010 ("Promotion").
05. To enter the Promotion, an Entrant must be following the Promoter's Twitter account located at http://twitter.com/bravenewcode. The Entrant must also issue a tweet from their own Twitter account as follows: 

“BraveNewCode is GIVING AWAY a 64GB iPad 3G and WPtouch Pro to celebrate WPtouch Pro 2.1! (RT, Follow to enter) Details: http://t.co/pbmhiSk”

06. The Entrant’s Tweets must not be protected during the Promotion period.
07. There is no limit on entries per person. Each new Tweet will constitute an Entry.
07a. One (1) prize per Entrant.

Prizes Draw

08. Winners will be randomly drawn from all valid entries. Entries will be numbered and a random number generator will select the winners.

The Promoter will notify the winners via Twitter from the Promoter’s Twitter account. If a selected winner is unreachable, ineligible, disqualified or fails to claim the Prize within three (3) days, the winner automatically forfeits the Prize and a new winner will be randomly drawn.

Prize A can only be shipped to addresses in North America or EU countries. Address must not be in the form of P.O. boxes or Military addresses.

The Prizes

09. The Promotion Prizes are one (1) of the following:
- One (1) Apple iPad, 64GB solid state storage and 3G/WiFi wireless networking, along with one (1) WPtouch Pro Developer License (“Prize A”)
- One (1) WPtouch Pro 5-Pack License (“Prize B”);
- One (1) WPtouch Pro Single License (“Prize C”);
- One (1) WPtouch Pro Single License (“Prize D”);
- One (1) WPtouch Pro Single License (“Prize E”)

Here-within, the collection of individual prizes will be referred to as ("Prizes").

10. Prize A will be mailed within 72 hours of the receipt of the shipping address given by the winner. Prize A will be shipped and insured at the expense of the Promoter. 
10b. Prizes B to E will be provided as instructions by text e-mail to the winners.

11. The winners are responsible for any taxes, duties, customs fees, brokerage or other costs associated with the receivership of Prizes.
12. Under no circumstances, for any reason, will cash be given in exchange for Prizes. Prizes are non-transferable, non-negotiable and cannot be substituted for any other Prizes or cash value.
13. The Promoter reserves the right to substitute all or any part of the Prizess for one (1) of an equivalent or greater value, if necessary for reasons beyond its control; any change(s) will be final and binding upon every Entrant in the Promotion.
14. The Promoter will not be held liable for Prizes if they do not reach the winner where the Promoter can prove its attempt to send the Prize to a winner.
15. The Promoter, its agents, employees, representatives, associates, affiliates, directors, and subsidiary companies  shall not be liable in any way for any failure, liability or breach by any third party in connection with this Promotion or Prizes and accepts no responsibility for any loss, property damage or personal injury suffered by the winner relating to this Promotion or the Prizes, except as may be required by law in the Province of Ontario, Canada. The Promoter, its agents, employees, representatives, associates, affiliates, directors, and subsidiary companies are fully excluded from liabilities arising for reasons beyond its control, including but not limited to any act or default of any third party supplier.

Promoter

16. The Promoter of this Promotion is BRAVENEWCODE INC. A Corporation residing at: 66 Bay St. South, Hamilton, ON, L8P 4Z6 Canada. The (“Promoter”).
17. Apple, Inc. is in no way affiliated, nor endorses BRAVENEWCODE INC. in conjunction with this Promotion.
18. Entrants indemnify the Promoter, its agents, employees, representatives, associates, affiliates, directors, and subsidiary companies against any and all claims, losses, costs, damages, liability and expenses arising out of the Entrant’s breach of any of these terms and conditions.
19. Each Entrant, by entering this Promotion expressly releases the Promoter, its agents, employees, representatives, associates, affiliates, directors, and subsidiary companies from any claim, action or demand arising out of or in connection with the Prize Promotion or their Prizes, if any.
